This Commission report, in accordance with the 2011 Treaty on the Accession of Croatia to the European Union (‘Act of Accession’), is an update on Croatia’s transitional arrangements with respect to the purchase of agricultural land by European Union (EU) and European Economic Area (EEA) nationals. Upon accession to the European Union, Croatia was authorised a transitional period of 7 years (2013-2020), with a possible 3 year extension of this period to be decided in 2020. During this transitional period, Croatia is permitted to maintain pre-existing restrictions on the acquisition of agricultural land by non-Croatian nationals of the EU and EEA. Whilst the fundamental Freedom of Capital includes agricultural land, the EU Treaties do allow member states to impose suitable rules to attain legitimate public policy objectives, such as sustainable rural development.
