Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL amending Regulation (EU) 2019/501 and Regulation (EU) 2019/502 as regards their periods of application

On 19 December 2018, the European Commission published a Communication and 14 legislative proposals to address a number of issues that would arise if the UK leaves the EU without concluding a Withdrawal Agreement. As a result, on 25 March 2019 the European Parliament and the Council adopted Regulation (EU) 2019/501 ensuring basic road connectivity and Regulation (EU) 2019/502 ensuring basic air connectivity. The proposal tabled by the Commission on 4 September 2019 would amend those two Regulations by extending the period of validity by seven months, corresponding to the length of the current extension of the Article 50(3) TEU period, maintaining the logic and intended duration of the original Regulations.

2. The Commission proposes extending the application period of Regulation (EU) 2019/501, ensuring basic road freight and road passenger connectivity, from 31 December 2019 until 31 July 2020. Regulation (EU) 2019/501 governs the way Member States treat UK hauliers and passenger transport operators when operating in the EU. The substance of the current Regulation, which will not be changed by the Commission’s new proposal, includes allowing point-to-point, limited cross trade and cabotage journeys for UK hauliers, as well as regular and special regular journeys for UK passenger transport operators. In order to ensure that the provisions apply for the period after exit that was initially intended, it is also proposed that the period during which road passenger (i.e. bus/coach) cabotage services can be performed in the border region of Ireland is to be defined as six months starting from the date of application of the Regulation (this provision was previously due to end on 30 September 2019).
