On 28 November 2003, the Council authorised the Presidency, assisted by the Secretary-General/High Representative, to open negotiations with and conclude an Agreement between the European Union and Canada concerning the security of information. The decision presented is the draft text of that Agreement.
The Agreement addresses the following subjects: a description of what is meant by ‘classified information’ (and ‘protected information’ for Canada); an understanding of the institutions and entities to which this Agreement applies; a commitment that the receiving party will protect classified information provided to them to a level at least equivalent to that afforded by the providing party for its own information; restrictions on how such information will be used, accessed, and disclosed; equivalent European Union and Canadian markings; personnel security clearance requirements for accessing classified information; a commitment to hold classified information in a secure location; how classified information is to be provided to contractors; procedures on how classified information will be exchanged physically between the parties; a commitment that the two Parties will negotiate and enter into implementing arrangements that will provide further detail; responsibilities for overseeing the implementation of the Agreement; the responsibilities of each Party in the event of the loss or compromise of classified material; dispute resolution; and details on how the Agreement will enter into force, including how it can be amended or terminated.
