COMMUNICATION FROM THE COMMISSION Commission Notice on Access to Justice in Environmental Matters
1. The Commission considers that outside the scope of harmonised EU secondary legislation, the current legislative provisions in Member States on access to justice in environmental matters (arising from obligation under The Aarhus Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters ('the Aarhus Convention')) differ considerably. The Commission has identified a number of problems. Having considered several options, they decided that an Interpretative Communication on access to justice in environmental matters (ie the Notice) would be the most appropriate and effective means to address the problems.
