COMMISSION STAFF WORKING DOCUMENT Replies to questionnaire on quantitative information on the practical operation of the European arrest warrant - Year 2016
1. The report provides a breakdown of statistics on the European Arrest Warrant (EAW) in calendar year 2016 from data collated by the European Commission from each European Union (EU) Member State. The document is not a legislative proposal, nor does it informally propose any policy changes.
2. The EAW Council Framework Decision (2002/584/JHA) is the reciprocal extradition arrangement which governs extradition between EU member states. The EAW is a simplified and faster extradition procedure for prosecution or executing a custodial sentence or other detention order. A warrant issued by one EU member state is valid in the entire territory of the EU. The EAW became operational in 1 January 2004 and replaced the former lengthy extradition procedures between EU countries. The EAW is implemented in the UK through Part 1 of the Extradition Act 2003.
3. The data in the report was requested by the European Commission to analyse indicative statistics and processes fundamental to the operation of the EAW to help establish a clear overview of how the EAW is operating and where improvements might be made. Whilst all Member States provided a response to the European Commission, the level of information provided varied across Member States.
