COMMISSION DELEGATED REGULATION (EU) …/... of 5.7.2021 amending Annexes II and IV to Regulation (EU) 2019/1009 of the European Parliament and of the Council for the purpose of adding precipitated phosphate salts and derivates as a component material category in EU fertilising products
1. Regulation (EU) 2019/1009 lays down rules on the making available on the market of EU fertilising products. It has a staggered application with some articles having applied since July 2019, some from April 2020 and the remainder applying from July 2022. When Regulation (EU) 2019/1009 applies in its entirety from July 2022 it will replace the existing EU legislation in this area (Regulation (EC) 2003/2003). The Regulation paves the way for new fertilising types, intended to promote the ‘circular economy’ and harmonises the requirements for fertilisers produced minerals and from organic and waste materials in the European Union (EU). It also sets harmonised limits for a range of contaminants. The three delegated regulations make specific alterations to the annexes of Regulation (EU) 2019/1009 which outline the component materials that EU fertilising products can be comprised of, the conformity assessment tests that EU fertilising products need to undergo and the labelling regime that applies to EU fertilising products to gain access to the market.
2. Delegated regulation C(2021)4743 amends Annex II to Regulation (EU) No 2019/1009 by adding precipitated phosphate salts and derivates as a new Component Material Category, and Annex IV to the Regulation by setting up the legal framework for the relevant conformity assessment for EU fertilising products containing precipitated phosphate salts and derivates.
