COMMISSION DELEGATED REGULATION (EU) …/... of 28.11.2018 amending Delegated Regulation (EU) No 1062/2014 as regards certain active susbtances/product-type combinations for which the competent authority of the United Kingdom has been designated as the evaluating competent authority
1. Biocidal products control harmful or unwanted organisms through chemical or biological means. They are used in a wide variety of industries to control organisms such as viruses, bacteria, fungi, and vermin. Some are also used by members of the public. Once an active substance has been approved, companies can then apply via different application routes for an ‘authorisation’ to sell biocidal products containing the active substance in Member States.
2. The Biocidal Products Regulation (EU) No 528/2012 (BPR) makes provision for the evaluation and approval of all biocidal active substances that can be used in biocidal products. This has a linked rolling programme to review all active substances used in biocidal products which were already on the market in May 2000. Prior to that pre-existing national legislation applies to biocidal products containing those substances. The Review Regulation (EU) No 1062/2014 sets out the details of the review programme and the original Annex II had included the UK as the evaluating competent authority for certain substances on behalf of the Union.
